DMCA Policy for "Art & Entertainment"
Introduction
This Digital Millennium
Copyright Act ("DMCA") Policy applies to the website "Art &
Entertainment" (https://newsartsentertainment.blogspot.com). We
respect the intellectual property rights of others just as we expect others to
respect our rights and have established the following policy in accordance with
the DMCA.
Copyright
Infringement
Under the DMCA, copyright
owners have the right to notify us via our designated agent listed below, if
they believe that a user of our website has infringed the copyright owner's
work(s). Notifications of claimed copyright infringement must be submitted in
writing to our designated agent for receiving such notifications.
To be effective, the
notification must include:
1.
A physical or electronic signature of a person authorized to act
on behalf of the owner of an exclusive right that is allegedly infringed.
2.
Identification of the copyrighted work claimed to have been
infringed, or, if multiple copyrighted works at a single online site are
covered by a single notification, a representative list of such works at that
site.
3.
Identification of the material that is claimed to be infringing or
to be the subject of infringing activity and that is to be removed or access to
which is to be disabled, and information reasonably sufficient to permit us to
locate the material.
4.
Information reasonably sufficient to permit us to contact the
complaining party, such as an address, telephone number, and, if available, an
electronic mail address at which the complaining party may be contacted.
5.
A statement that the complaining party has a good faith belief
that use of the material in the manner complained of is not authorized by the
copyright owner, its agent, or the law.
6.
A statement that the information in the notification is accurate,
and under penalty of perjury, that the complaining party is authorized to act
on behalf of the owner of an exclusive right that is allegedly infringed.
Please note that any person
who knowingly materially misrepresents that material or activity is infringing
may be subject to liability.
Counter-Notice
The provider of the allegedly
infringing content may make a counter-notice pursuant to sections 512(g)(2) and
(3) of the US Copyright Act. To file a counter-notice with us, the provider of
the allegedly infringing content will need to provide a written communication
that sets out the items specified below.
If we receive a
counter-notice, we may send a copy of the counter-notice to the original
complaining party informing them that we may replace the removed material or
cease disabling it in 10 business days. Unless the copyright owner files an
action seeking a court order against the allegedly infringing content provider,
the removed content may be replaced, or access to it restored, in 10 to 14
business days or more after receipt of the counter-notice, at our discretion.
Please note that any person
who knowingly materially misrepresents that material or activity was removed or
disabled by mistake or misidentification may be subject to liability.
